An Attorney-Owned 1031 Exchange Qualified Intermediary

WealthBuilder 1031 is a nationwide qualified intermediary owned and run by Chris Peterson, a Texas-licensed attorney. We have handled 1031 exchanges since 2009. Our job is to prepare the exchange documents, hold your sale proceeds and work with your closing agents.
When you hire WealthBuilder 1031, you hire us as your qualified intermediary. That engagement does not make us your attorney.
Do you need a 1031 exchange attorney?
A delayed exchange generally needs an independent qualified intermediary to hold the sale proceeds. Your own attorney usually can't fill that role. Under the Treasury regulations, a lawyer who has represented you in the past two years is not independent enough to serve as your QI.
You may still want your attorney for legal advice on the contract, title or ownership. We work alongside your attorney and CPA.
What attorney ownership gives you
- Exchange documents written and kept current by an attorney.
- Early checks for exchange problems, like a missing cooperation clause or title held in the wrong name, flagged for you and your attorney.
- Experience with the harder structures. Reverse and improvement exchanges use a separate company to hold title, and the IRS rules for that are strict.
- Fund safeguards designed by someone who watched clients get hurt when a QI failed. See how we protect your money.
How we work with your advisors
Your CPA calculates your expected gain and tax. Your attorney handles legal advice, contract questions and ownership planning. We handle the qualified intermediary's role and coordinate with both.
Bring us in before your sale closes, especially when:
- You own the property with partners or through an LLC, and not everyone wants to exchange.
- Some cash from the sale will come to you instead of going into the replacement property.
- You want to buy the replacement property before you sell.
- You plan to build or improve the replacement property with exchange funds.
- Your contract or title has an issue that needs legal work.
